Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Calybite mobile application and related services (the “App”). The App is operated by Semangix (“Calybite”, “we”, “us”, or “our”).

By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Who we are

Calybite is a wellness tracking app. It helps you log meals, estimate calories and macros, track water, view progress, chat with an in-app coach, and optionally sync activity and vitals from Apple Health (iOS) or Health Connect (Android).

2. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your country, if higher) to use the App. If you are under 18, you may use the App only with a parent or guardian’s permission. The App is not intended for children under 13.

3. Your account

• You may sign in with Google (Android and other supported platforms) or Sign in with Apple (iOS).
• You are responsible for activity on your account and for keeping access to your sign-in method secure.
• Provide accurate onboarding information (such as sex, date of birth, height, weight, activity, and goals). Plans and estimates depend on it.
• You may delete your account at any time from Profile → General → Delete Account. Deletion removes your Calybite account and associated app data from our systems, subject to our Privacy Policy and applicable law.

4. The service

The App may include: - Camera and photo library access to scan or attach meal photos - Manual meal logging and nutrition editing - Daily water logging - Onboarding questionnaire and a generated weekly calorie/macro plan - In-app chat with an AI coach (your pet companion) - Analytics (calories, macros, water, and related charts) - Optional connection to Apple Health or Android Health Connect - Push notifications (if you allow them) - Approximate location used only to infer country for meal suggestions (not continuous tracking)

Features may change, and some (including Calybite Plus / premium) may be paid or limited.

5. Not medical advice

Calybite is not a medical device and does not provide medical, dietary, or clinical advice. Calorie counts, macros, glucose or blood-pressure values shown from Health, plans, and chat replies are estimates or third-party health samples for general wellness only. They can be wrong. Do not use the App to diagnose, treat, or manage any condition. Always consult a qualified clinician or dietitian before changing diet, exercise, or medication.

6. Nutrition estimates and AI

• Meal photos and descriptions may be processed by artificial intelligence and matched against our food database, which includes data derived from OpenNutrition.
• You can edit any estimate before saving. What you save is what we store as your log.
• AI chat can be incomplete or incorrect. It cannot log meals, change goals, or write to Health for you.
• You agree not to upload images or text that you do not have the right to use, or that are unlawful, sexual involving minors, or intended to harm others.

7. Health platforms (optional)

Connecting Apple Health or Health Connect is optional. If you connect: - We request only the types described in the Privacy Policy (for example steps, heart rate, blood pressure, blood glucose). - You can revoke access in iOS Health, Android Health Connect, or the App. - We do not sell health data. Availability of data depends on what other apps and devices write into those platforms.

8. Acceptable use

You agree not to: - Reverse engineer, scrape, or overload the App or our APIs except as allowed by law - Attempt to access other users’ accounts or data - Abuse AI, camera, or chat features (including automated bulk requests) - Use the App for anything illegal - Interfere with security or authentication

We may suspend or terminate access if we reasonably believe you have violated these Terms.

9. Intellectual property

The App’s design, trademarks, software, and content (excluding your logs and third-party data) belong to Semangix. You receive a personal, non-exclusive, non-transferable license to use the App for your own wellness tracking. OpenNutrition and other third-party datasets remain subject to their own licenses.

You grant us a limited license to host and process content you submit (photos, logs, chat messages) only to operate and improve the App, as described in the Privacy Policy.

10. Paid features

If we offer paid subscriptions (for example Calybite Plus), prices, billing period, and cancellation will be shown in the App or store listing (Apple App Store / Google Play). Store refunds follow Apple or Google rules. Unless required by law, fees are non-refundable after the period starts.

11. Third-party services

The App relies on third parties, including authentication (Google, Apple, Firebase), hosting, image storage, push delivery, and AI providers. Their terms also apply when you use those sign-in methods. We are not responsible for outages or changes on those platforms.

12. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that estimates, uptime, or Health sync will be accurate or uninterrupted.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEMANGIX AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM (OR USD $50 IF YOU PAID NOTHING).

Some jurisdictions do not allow certain limits; in those places, our liability is limited to the fullest extent allowed.

14. Indemnity

You will defend and indemnify Semangix against claims arising from your misuse of the App, your content, or your violation of these Terms or the law.

15. Changes

We may update these Terms. We will change the date and version shown with this document. Continued use after the update means you accept the new Terms. Material changes may also be noted in the App.

16. Governing law

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Courts in Karachi, Pakistan have exclusive jurisdiction, except where consumer law in your country requires otherwise.
